Gift Card Terms and Conditions; Web Site User Agreement

Welcome to Luxe Now! This User Agreement sets forth the "terms and conditions" which govern your use of LuxeNow Gift Cards and our Web site. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. Your use of the gift card and this site is expressly conditioned on your acceptance of the following terms and conditions, which may be updated from time to time without notice to you. By using this site, you acknowledge your assent to these terms and conditions.

I. Gift Card Terms and Conditions

Purchase and use of a LuxeNow Gift Card constitutes acceptance of the following terms and conditions:

The LuxeNow Gift Card is not replaceable if lost or stolen and should be treated as cash. Neither LuxeNow nor any promotional partner nor any partner nail salon is responsible for loss, theft, or mutilation of this card. This card cannot be redeemed for cash except in accordance with applicable law. Face value of is for the service specified on the face of the card. Unauthorized resale, swap or other exchange will invalidate this card.

When properly authorized, this gift card may be redeemed for salon services indicated on the face of the card at participating LuxeNow partner nail salons.

Gift cards may be redeemed only at participating nail salons listed on giftcards.luxenow.com. Neither LuxeNow nor any promotional partner nor any partner nail salon will be responsible for appointments or reservations booked at non-participating nail salons.

The service(s) indicated on the face of the gift card must be redeemed at a single participating salon in a single visit.  Your LuxeNow Gift Card must be surrendered at time of redemption.

LuxeNow is an independent company and not affiliated with any partner nail salon.

Neither LuxeNow nor any promotional partner makes any warranty of any kind regarding any service you may receive in connection with your use and redemption of this card.

Neither LuxeNow nor any promotional partner assume any responsibility and shall not be liable for any injury, loss, claim, cost, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability, or otherwise which arises out of or is in any way connected with (i) your use and redemption of this certificate or (ii) the performance or non-performance by any third party providers even if you have been advised of the possibility of damages. Under no circumstance shall LuxeNow or any promotional partner be liable for any delay or failure of performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control.

II. Web Site Terms of Use

1. OWNERSHIP. The contents of this site, including text, graphics, images, logos, icons, software, and other content (collectively, "Web Site Content") are protected under United States and foreign copyright, trademark, and other proprietary laws. The compilation (meaning the collection, arrangement and assembly) of all Web Site Content is also protected under United States and foreign copyright, trademark and other proprietary laws.

2. LIMITED LICENSE. By this User Agreement, and subject to the terms and conditions of this User Agreement, you are granted a limited, non-exclusive and non-transferable license to the extent necessary and required to use the software and documentation necessary to access, explore and otherwise use this Web site.

3. USE OF SITE. You are free to use our site for information purposes as set forth above. You may only use our site to legitimately purchase products.

4. AGE AND RESPONSIBILITY. You are responsible for maintaining the confidentiality of your account information, your password and your login information. You agree to accept responsibility for all activities that occur under your account or password. You represent that you are of sufficient legal age to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site. You understand that you are financially responsible for all uses of this site by you and those using your login information.

5. PRIVACY. You have read the Privacy Policy,  the terms of which are incorporated herein, and agree that the terms of such policy are reasonable. You consent to the use of your personal information by Luxe Now and/or its third party providers, partners and affiliates in accordance with the terms of and for the purposes set forth in the Privacy Policy.

6. HEADINGS. The headings used in this User Agreement are included for convenience only and will not limit or otherwise affect the terms and conditions herein.

7. ENTIRE AGREEMENT. This User Agreement, together with any terms and conditions incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this site.
